Guest Terms of Use

1. Who we are

Dinn is a platform operated by Artsiom Khamiakou, sole proprietor, ul. Straganiarska 20/22/35, 80-837 Gdańsk, Poland, NIP 8982278013 ("Dinn", "we", "us").

2. Our role

Dinn provides the technology that lets a venue offer you a digital menu, collect your order, route your payment, and receive your review. Dinn is not the seller of the food, drinks or services you order. The contract of sale is concluded directly between you and the venue whose QR code or link you used. The venue is responsible for:

  • preparing and delivering your order;

  • providing receipts, invoices, and fulfilling consumer-protection obligations;

  • handling refunds, complaints, and food-safety matters.

3. Using the Service

You may use the Dinn-powered menu to browse, order, pay, tip, and leave reviews. By using the Service you agree to:

  • provide accurate information when placing a delivery order;

  • not misuse the Service (e.g., fraudulent orders, fake payment details, malicious automated use, scraping);

  • respect the venue, its staff and other Guests;

  • leave only truthful, relevant reviews that do not contain unlawful, offensive or defamatory content, and that do not disclose other people's personal data.

  • We may remove reviews or restrict access to the Service if these rules are breached.

4. Orders and payment

  • 4.1 When you place an order, you make an offer to the venue to purchase the selected items at the price shown. The contract is formed when the venue accepts the order (typically automatically through the system).

  • 4.2 Prices, availability and allergen / dietary information are provided by the venue. Dinn does not verify their accuracy.

  • 4.3 Payments are processed by third-party payment service providers (e.g., Stripe, Przelewy24, Apple Pay, Google Pay). Your payment-card or account data is provided directly to the payment service provider — Dinn does not see or store full card numbers.

  • 4.4 Tips given through the platform go to the venue (or, where the venue has configured it, to its staff).

5. Refunds, complaints and consumer rights

  • 5.1 The venue handles refunds, complaints and any applicable consumer rights (e.g., for non-conforming goods). If you experience a problem with your order, please contact the venue first. If the venue does not respond or the matter cannot be resolved, you may also contact Dinn at info@dinn.app and we will assist where we can.

  • 5.2 In the case of a dispute involving a paid order, the payment service provider's chargeback procedures also remain available.

6. Privacy

Our processing of your personal data is described in the Privacy Policy at dinn.app/privacy and the venue's own privacy notice. In short:

  • Session and order data is processed by Dinn on behalf of the venue.

  • Your IP address is stored in session logs for up to 90 days, for security and troubleshooting.

  • Your delivery details (if you place a delivery order) are kept for 90 days after fulfilment.

  • Optional review email is stored only to notify you of a reply and is used for no other purpose.

  • To exercise GDPR rights (access, deletion, etc.), email privacy@dinn.app and include the session ID shown on your order confirmation where possible.

7. Intellectual property

The Dinn platform, software, logos and related materials are owned by Dinn or its licensors. Venue content (menus, images) is owned by the respective venue. Nothing in these Guest Terms grants you any right to reuse this content beyond personal use of the Service.

8. Disclaimer and liability

  • 8.1 The Service is provided "as is" to Guests. Dinn does not guarantee uninterrupted or error-free operation.

  • 8.2 Dinn is not liable for the quality, safety, legality, accuracy of description or delivery of the items you order — those are the responsibility of the venue.

  • 8.3 Nothing in these Guest Terms excludes or limits Dinn's liability for willful misconduct, gross negligence, death or personal injury, or any other liability that cannot be excluded under applicable law, including Polish consumer-protection law where you use the Service as a consumer.

9. Changes

We may update these Guest Terms from time to time. The current version is always available at dinn.app/guest-terms.

10. Governing law and disputes

These Guest Terms are governed by Polish law. Nothing in this clause deprives you of the protections available to you under mandatory consumer-protection law in your country of residence. As a consumer, you may also use the EU online dispute resolution platform at https://ec.europa.eu/consumers/odr/.
